Terms.

Effective: 13 September 2026

These terms govern your use of OTHERWISE, including the website, first-release order flow, copy-status pages, companion interactive experience and any paid digital access that may be enabled. The service is operated by Ekarth Ventures Private Limited.

Operator: Ekarth Ventures Private Limited
CIN: U62099TN2024PTC169251
Registered Office: 46 College Road, Nungambakkam, Chennai – 600006, Tamil Nadu, India.

First release

The first release is intentionally limited. Orders are accepted into this first allocation and fulfilled while copies remain available. An order confirmation records that the order was received; it does not itself mean a physical copy has been allocated, dispatched or delivered. The copy-status page reflects the actual fulfilment state as it advances.

Any applicable price, payment requirement or other material order term is the term shown in the order path before commitment. We do not treat an order as dispatched until the fulfilment state actually reaches dispatch.

Fulfilment, cancellations and returns

If an order has not yet been fulfilled, you may contact us to ask that it be cancelled. Dispatch or delivery may make cancellation impracticable. Any applicable cancellation, replacement and return rights shown on the order page apply subject always to non-excludable rights under applicable law.

Digital access and payments

Some interactive experiences or digital features may be free and others may require payment after a stated threshold or access condition. Any price, duration, renewal condition and material access restriction should be shown before payment. Where payment is enabled, payment processing may be provided by a third-party payment provider.

Once digital content or access has been supplied, cancellation or refund rights may be limited to the extent permitted by applicable law. Nothing in these terms removes rights that cannot legally be waived.

Acceptable use

You may use the site and experiences for personal, lawful use. You must not interfere with the service, bypass access controls, misuse another person’s copy credential, attempt unauthorized access, introduce malicious code, or use the service in a way that violates applicable law or the rights of others.

Intellectual property

OTHERWISE is created by Pranav Nahar. The book, characters, worlds, artwork, text, interactive elements, original terminology, logos, interface material and associated creative content are protected by applicable copyright, trademark and other rights. Ekarth operates the service under authorization; operation of the website does not by itself transfer ownership of the underlying OTHERWISE intellectual property to Ekarth.

You may view and interact with the material for personal use. Except where law expressly permits, you may not reproduce, publish, distribute, commercially exploit, create unauthorized derivative works from, scrape at scale, remove rights notices from, or use protected OTHERWISE material to train or build a competing commercial model or dataset without permission from the relevant rights holder.

Experimental and reflective content

The companion experience may observe actions such as timing, choices, movement or interaction state. It is not a medical, psychological, psychiatric or diagnostic service. Results are reflective interface outputs, not professional assessments or hidden scores about you.

Availability and changes

We may change, suspend or discontinue parts of the site, interactive experience, first-release programme or access model. We do not promise uninterrupted or error-free availability. We may repair or update content where necessary for security, functionality, legal compliance or the integrity of the experience.

Third-party services

The service may rely on hosting, payments, delivery, communications and other third-party providers. Their own terms and privacy practices may apply to the services they directly provide.

Liability

To the maximum extent permitted by law, the service is provided without warranties beyond those that cannot legally be excluded. Nothing in these terms excludes liability where exclusion would be unlawful. Otherwise, liability will be limited to losses that are reasonably foreseeable and directly connected with a breach of these terms.

Governing law

These terms are governed by the laws of India. Subject to any mandatory consumer or other jurisdictional protections that apply, courts at Chennai, Tamil Nadu shall have jurisdiction over disputes arising from these terms or the operation of the service.

Privacy

Our handling of personal information is described in the Privacy notice.
